How long do I have to put a lawsuit on a hospital?How many yrs do i have to start a lawsuit?


I fell in lake in 2003 I was rushed to Hospital them Knowing I was seizure disorder,They had left me unattended with bed rails down I had went into a seizure and the bed,surgical tray and pump fell on me causing me to have surgey done on ancle after 8 months of pain before now since this happened I've had alot of memery loss,back pain ect...

You need to check the guidelines in your state. However, I think the normal amount of time is two years. Not for sure though.

The statute of limitations is different depending on the state you are in -- but most are shorter than 4 years. I'd consult a local attorney

You usually (depending where you live) have 2 - 3 years within which to file a Complaint at Law. By now though the Statute of Limitations has probably run and you cannot file it. Check with an attorney in your State.

Why did you wait so long? You would have to contact a lawyer who deals with medical malpractice, if he/she takes the case you might have a chance. You would have to ask the about the time limit. Usually the give a initial free consultation.

That depends upon state law and who operated the hospital. For example if it was operated by the Federal government (Military, VA, USPHS, etc.) it's already to late to file a claim.

Definitely talk to an attorney - you can ask if they'll represent you pro bono if you don't have the funds presently for a lawsuit. You need to ask them what the statute of limitations is in your state for a personal injury lawsuit of this type. You can ask that question over the phone and decide from there.

That is not something you can have a lawsuit on. As it would happened wither the nurse was there or not. You can sue them but you would get no where.

You had a seizure and some equipment fell on your ankle? How is this related to your memory loss and back pain? Did the equipment fall on your head and/or back also? You may have some sort of case for the ankle injury but you will have to prove causality from malpractice on the part of the hospital for the other injuries.

Have you talked to the hospital's legal department? They may just settle without a lawsuit being necessary.

Do you have an attorney? If you do, and you are asking this question, get a new attorney. If you don't have an attorney, this is the place to start.

Attorney's will take a case like yours without you paying any money to them at all on what is called contingency. They will have you sign a contract that will pay them anywhere from 40% to 60% of all the money they take the hospital for, after their expenses are deducted. That will leave you with the rest, anywhere from 40% to 20% of the total and you will still have what ever headaches you still have.

You may get some satisfaction, and you may end up with your headaches. In any event, involving a hospital in a lawsuit makes attorneys very happy.

You need to do as much footwork as any lawyer you hire!First,get your medical records.If you are getting a lawyer ,hospital charge for the records.Proof they had knowledge of your seisure.Send for your insurance papers,save your bills.Any physicals you had showing you had no previous injuries you got there. Had they already taken you to x-ray,then left you unattended.When they checked you in at E.R.it should list the complaints you had at the lake.
You can go to any bookstore,and online to do cross reference for statues of limitation.
You need to form 2 seperate notebooks one for a possible lawyer one for yourself.Make copies of all important documents.Make an index of the papers,so you can have them in order.And papers are easier for you to go through when looking for particuliar facts.Make a list also of what you want to prove(use highlighters as color codes) Keep all originals for yourself.
